Remote Witnessing – Tech Savvy Weddings
Good news! The Marriage Act now allows you to have your Notice of Intended Marriage (NOIM) witnessed remotely. Yes, you read that right. You can now do this via an audio-visual link. Perfect for those busy schedules or if we're not in the same place – seriously this can save some stressful times and… it’s here to stay!
But here's the catch:
If you and your partner are in Australia, your witness (who can be your celebrant) must also be in Australia.
If you're both overseas, the witness An Aussie Diplomatic or Consular Officer, A notary public, must also be overseas.
So, remote witnessing is a go, but make sure everyone's in the right place!
Separate Meetings – One-on-One Time
Another key change is the requirement for separate, in-person meetings with each party to the marriage. This ensures that both of you are freely and willingly saying yes … or as I like to say you are saying yes figuratively at the top of your lungs I absolutely, undoubtably want to marry this person!!
Do you have to be alone? Nope, nope, nope! Bring along anyone you want with the exception of the fantastical human you are just about to marry.
Timing's flexible:
Anytime, before the wedding day even on the day of the wedding, is fine BUT it must be before the ceremony.
This step is all about making sure everything's crystal clear and everyone’s on the same page.
Proof of Birth – What You Need
The rules around proving your date and place of birth have been tweaked too. The new order of acceptable documents is in place to make things clearer:
Birth Certificate or Passport
If those are impossible to get (and we mean truly impossible, not just inconvenient), then a statutory declaration is your backup.
Transfer of NOIM – Keep It Moving
You can now request to transfer your NOIM to another celebrant. This is a handy update if your original celebrant can't make it for any reason. Flexibility for the win!
Other Important Bits
There are a few other changes, like the introduction of deputy registrars for the Marriage Celebrants Program and extended application times for becoming an authorised celebrant. Plus, a celebrant now needs to be physically present at your wedding, along with both of you and your two witnesses.
